Terms of Service

Welcome to WantHave. These Terms of Service (the "Terms") are a binding agreement between you and Chateau Fiasco LLC, a California limited liability company doing business as WantHave ("WantHave," "we," "us," or "our"). They govern your use of the WantHave web application, websites, browser extensions, and related services (together, the "Service").
Our Privacy Policy explains how we handle your data. It's a separate document, but it's part of the deal — please read both.
The short version
- WantHave is free, currently invite-only, and in active development — things will change, and occasionally break.
- Be a decent human: don't scrape us, spam people, or post anything illegal.
- Group gifting is coordination only. We never hold, transfer, or process money. Pledges are promises between you and your friends, settled outside WantHave.
- Some links earn us a commission (including on our curated lists). That's how the Service stays free. It never costs you extra.
- Our automated email parsing is genuinely useful and occasionally wrong. Don't make it your only record of anything important.
- Disputes are resolved by individual binding arbitration, not court, and you waive class actions — but you can opt out within 30 days (Section 16).
1. Accepting These Terms
By creating an account, clicking "I agree," signing in through Google or another provider, or simply using any part of the Service, you accept these Terms. If you don't agree, don't use WantHave.
If you use the Service as a guest — for example, reserving a gift or joining a group gift on someone's public list without an account — these Terms apply to that use too.
2. Who Can Use WantHave
You must be at least 13 years old to use the Service. If you're under 18, you may only use WantHave with the permission and supervision of a parent or legal guardian, and you must be old enough to consent to our data practices in your country. We do not knowingly collect data from children under 13 — see the Children's Privacy section of our Privacy Policy.
By using the Service, you confirm that you meet these requirements and that any registration information you provide is accurate.
WantHave is currently invite-only. An invite code grants you access to the Service; it doesn't create any entitlement to continued access, and we may change or end the invite program at any time.
3. The Service (Free, Beta, Evolving)
WantHave helps you organize what you want to buy and what you own: wishlists, gift coordination, purchase and package tracking, email-receipt scanning, price alerts, a digital closet, subscription tracking, and curated lists — including curated lists we may suggest to you based on the items in your Wants and Haves.
The Service is free, and we currently support it through affiliate commissions (Section 9). The Service is also early: features may be added, changed, or removed at any time; data formats may evolve; and despite our best efforts, bugs happen. We'll communicate significant changes, but we can't promise the Service — or any specific feature — will always be available or stay the same.
4. Your Account
- Keep your password secure and don't share your account. You're responsible for activity that happens under your account.
- Give us accurate information and keep it current.
- One person per account. Don't sell, rent, or transfer your account or invite codes.
- Tell us promptly at privacy@wanthave.app if you suspect unauthorized access.
5. Acceptable Use
Don't misuse the Service. Specifically, you agree not to:
- Break the law, infringe anyone's intellectual property, or violate anyone's privacy;
- Post content that is illegal, harassing, hateful, sexually explicit, deceptive, or that you don't have the right to share — this applies to list titles, descriptions, comments, profile content, and uploads;
- Scrape, crawl, harvest, or bulk-download data from the Service, or access it by any automated means other than public search-engine indexing of pages we allow in robots.txt;
- Probe, overload, or interfere with the Service or its security features, or attempt to access accounts or data that aren't yours;
- Use the Service to send spam, run scams (including fake gift campaigns or pledge solicitations), or impersonate any person or brand;
- Upload malicious files, or attempt to bypass our upload validation;
- Resell or commercially exploit the Service or systematically extract its data;
- Use another user's shipping address for any purpose other than sending them the gift it was shared for.
Two rules get special treatment, because they protect everyone else on the Service:
Zero tolerance — inappropriate imagery. Never upload, or link to, inappropriate imagery anywhere on the Service — including nudity, pornography, sexually suggestive imagery, hate imagery, or crude, graphic, or otherwise offensive content. This applies to profile pictures, item images and links, list covers, receipts, and any other upload or URL.
Zero tolerance — abusive language. No hate speech, bullying, harassment, rudeness directed at another person, or sexually suggestive language — in comments, list titles and descriptions, profile text, item notes, or anywhere else text can be displayed.
Violating either rule results in immediate, automatic removal from the Service and deletion of your data — including the offending content, your profile picture, and your items — without prior warning or notice. There is no three-strikes policy for this category.
For everything else in this section, we may remove content or restrict accounts that violate it (see Section 13).
6. Your Content
You keep ownership of everything you create on WantHave— your lists, notes, comments, photos, and uploads ("Your Content").
So we can run the Service, you grant WantHave a worldwide, non-exclusive, royalty-free license to host, store, reproduce, adapt (for technical purposes like resizing images), and display Your Content — solely to operate, provide, and improve the Service. For content you choose to make public or share (public lists, profiles, comments on shared lists), this license includes displaying it to the audiences you chose and generating previews (like link cards and search snippets). This license ends when you delete the content or your account, except for copies in transient backups and content others have re-shared where your settings allowed it.
You're responsible for Your Content. We don't pre-screen user content, but we may remove anything that violates these Terms.
7. Wishlists, Reservations, and Guests
List owners control list visibility (public, private, password, friends-only, invite-only). If you make a list public, anyone with the link can see it — including search engines.
Guests can reserve gifts or join group gifts on shared lists by providing a name and email, without an account. Guests get the limited right to use those features, subject to these Terms. Reservations are a courtesy coordination tool — they don't obligate anyone to buy anything, and we can't guarantee another guest or user honors them.
8. Group Gifting — Read This One
Group gifting lets friends coordinate going in on a gift together. Here is the critical part:
WantHave never holds, collects, transmits, escrows, or processes money. Ever.
- A "pledge" is an informational statement of intent— "I'm in for about $20." It is not a payment, deposit, or enforceable debt created by us.
- One participant (the "buyer") purchases the gift directly from the retailer with their own money.
- Settling up happens entirely off-platform, between participants, using whatever method they choose (Venmo, cash, carrier pigeon). The "settle-up" handle a buyer may share is just a link we display — we never see balances, initiate transfers, or confirm payment.
- WantHave is not a party to any purchase or reimbursement between participants, is not a money transmitter, money services business, payment processor, or escrow agent, and has no obligation to mediate or make anyone whole if a participant doesn't pay their share.
If someone flakes on a pledge, that's between you and them. We know — we've been there. That's why pledges are visible to the group.
9. Affiliate Links and Curated Lists
Some product links on WantHave are affiliate links: if you click one and buy something, the retailer or an affiliate network pays us a commission. This includes links on curated and editorial lists published by the WantHave team. This never costs you anything extra and is how the Service stays free.
A few honest promises and disclaimers:
- We disclose affiliate relationships on pages where affiliate links appear, consistent with FTC Endorsement Guides.
- We never override an existing affiliate tag in a link you save — your intent (and your favorite creator's commission) is respected.
- Curated lists reflect our genuine opinions; commissions don't determine what we recommend.
- Prices, availability, discounts, and product details shown on WantHave are not guaranteed. They come from retailers, emails, and automated scraping, and can be stale or wrong. The price that matters is the one at the retailer's checkout.
10. Email Scanning and Automated Data — Accuracy Disclaimer
If you connect Gmail, our automated tools (pattern matching plus AI) extract purchases, shipments, prices, return windows, warranties, and discount codes from your email. These tools may:
- Miss order confirmations, receipts, or shipping notifications;
- Misread an email as a purchase, or attribute a purchase to the wrong vendor;
- Extract incorrect prices, items, dates, deadlines, or tracking details;
- Miss or misidentify discount codes, gift cards, return windows, or warranty periods.
We improve these systems constantly, but WantHave is not a substitute for your own records. Don't rely on it as your sole source for financial record-keeping, tax reporting, return deadlines, warranty claims, or anything with real consequences — verify important information against the original email or the retailer.
11. Third-Party Sites, Retailers, and Services
WantHave links out to retailers and other third-party sites. We are not the seller of anything you buy: every purchase is a transaction between you and the retailer, on the retailer's terms. We're not responsible for third-party sites' content, pricing, shipping, returns, warranties, or privacy practices. Package-tracking data comes from carriers and tracking providers and can lag or err.
12. Intellectual Property
The Service — including its software, design, text, graphics, logos, and the WantHave name and marks — is owned by Chateau Fiasco LLC or its licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes under these Terms. Don't copy our code or design, use our marks without permission, or remove proprietary notices. Product names, images, and retailer trademarks shown on the Service belong to their respective owners; their appearance doesn't imply endorsement.
13. Termination
You can stop using WantHave at any time and delete your account from Settings, which permanently deletes your personal data as described in the Privacy Policy.
We may suspend or terminate any account that violates these Terms, engages in abusive behavior, or uses the Service in a manner harmful to other users or to WantHave. Violations of the zero-tolerance rules in Section 5 (inappropriate imagery, abusive language) result in immediate termination and deletion of your data without prior notice. Upon termination for abuse, we are not obligated to retain your data and may delete it immediately. We may also discontinue the Service (or any part of it) — if we ever discontinue the whole Service, we'll give reasonable notice and a chance to export your data.
Sections that by their nature should survive termination do survive — including Sections 6 (license, for content already shared), 8–11 (disclaimers), 12, and 14–19.
14. Disclaimers ("As Is")
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, secure, or that any data shown (including parsed purchases, prices, deadlines, and tracking) is accurate or complete. Some jurisdictions don't allow certain warranty disclaimers, so parts of this section may not apply to you.
15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHATEAU FIASCO LLC AND ITS MEMBERS, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — including loss of profits, data, use, or goodwill — resulting from: (a) your use of or inability to use the Service; (b) errors, inaccuracies, or omissions in automated email scanning, purchase tracking, price alerts, deadline alerts, or discount-code detection; (c) any group-gifting arrangement, pledge, or settlement between users; (d) any purchase from, or conduct of, a third-party retailer; (e) unauthorized access to your data; or (f) any other matter relating to the Service.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (a) THE AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (b) ONE HUNDRED U.S. DOLLARS ($100.00). Because WantHave is free, the amount in (a) may be $0.
Some jurisdictions don't allow limits on certain damages; in those places, our liability is limited to the smallest amount the law allows. Nothing in these Terms limits liability that cannot lawfully be limited, including for fraud, willful misconduct, or gross negligence.
16. Dispute Resolution: Arbitration and Class Action Waiver
Please read this section carefully — it affects your legal rights. You can opt out (see 16.6).
16.1 Talk to us first
Before filing any claim, email privacy@wanthave.app with a written description of the dispute. We'll try in good faith to resolve it informally within 60 days. Most things can be fixed with an email.
16.2 Binding arbitration
If we can't resolve it informally, you and WantHave agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Privacy Policy, or the Service — including whether a dispute is arbitrable — will be resolved exclusively by final, binding arbitration before a single arbitrator, rather than in court. Arbitration is administered by JAMS under its Streamlined Arbitration Rules and Procedures and, where applicable, the JAMS Consumer Arbitration Minimum Standards. The arbitration will take place in the county where you live, in California, or another mutually agreed location, and may be conducted by video at your election. Where the JAMS consumer standards apply, your filing fee is capped at the amount those standards set, and we pay the remaining arbitration costs. The arbitrator may award the same individual relief a court could, and judgment on the award may be entered in any court of competent jurisdiction. The Federal Arbitration Act governs this agreement to arbitrate.
16.3 Class action and jury waiver
All disputes will be resolved on an individual basis only. You and WantHave each waive the right to participate in a class action, class-wide arbitration, or consolidated or representative proceeding, and each waive the right to a jury trial. If a court finds this class waiver unenforceable as to a particular claim, that claim (and only that claim) shall proceed in court, not in class arbitration, and the rest of this section remains in force.
16.4 Exceptions
Either party may (a) bring an individual claim in small-claims court, or (b) seek injunctive or other equitable relief in court for intellectual-property infringement, data security, or unauthorized access. For EU/EEA residents: nothing here limits your right to complain to your data-protection authority, and your mandatory statutory consumer rights are unaffected.
16.5 One-year limit
Any claim must be filed within one (1) year after it accrues, unless applicable law requires a longer period.
16.6 Your 30-day right to opt out
You may opt out of this arbitration agreement and class waiver — with no effect on any other part of these Terms — by emailing privacy@wanthave.app with subject line "Arbitration Opt-Out" within 30 days of first accepting these Terms. Include your name and the email on your account. Opting out has no negative consequence to your use of the Service.
17. Indemnification
You agree to indemnify, defend, and hold harmless Chateau Fiasco LLC and its members, officers, employees, agents, partners, and affiliates from claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from Your Content, your use of the Service, your violation of these Terms, your violation of any third party's rights, or any dispute between you and another user (including group-gifting settlements).
18. Governing Law
These Terms, and any dispute arising from them or the Service, are governed by the laws of the State of California, United States, without regard to conflict-of-law rules. For any claim not subject to arbitration, you and WantHave consent to the exclusive jurisdiction of the state and federal courts located in California.
California consumer notice: Under California Civil Code §1789.3, California users are entitled to know they may file complaints with the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs, 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by phone at (800) 952-5210.
19. Changes to These Terms
We may update these Terms as the Service evolves. If a change is material — especially anything affecting Section 16 — we'll notify you by email or a prominent in-app notice before it takes effect, and material changes to the arbitration provisions won't apply retroactively to disputes that arose before the change. Continued use of the Service after changes take effect means you accept them. If you don't agree, stop using the Service and delete your account.
20. Miscellaneous
- Severability. If any provision of these Terms is held unenforceable, it will be modified to the minimum extent necessary, and the rest remains in effect.
- Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and WantHave about the Service, superseding prior agreements.
- No waiver. Our not enforcing a provision isn't a waiver of it.
- Assignment. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets, with notice to you.
- No third-party beneficiaries. Except as stated in Sections 15 and 17, these Terms create no third-party rights.
